GOUVERNEUR State police on Tuesday charged Timothy R. Irvine II, 27, Ogdensburg, with aggravated driving while intoxicated and aggravated unlicensed operation after he allegedly crashed his vehicle and it burst into flames.
Troopers said that about 5 p.m. on Peabody Road, Mr. Irvine drove his vehicle off the road and struck a utility pole. His vehicle caught fire. The Gouverneur Fire Department responded and extinguished the flames. Mr. Irvine suffered slight cuts to his head and was treated at the scene by the Gouverneur Rescue Squad.
He had a blood alcohol content of 0.19 percent, troopers said. A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI is charged when the BAC is 0.18 percent or above.
Troopers said Mr. Irvine told them he was using his cellphone at the time of the crash. He further was cited with use of a cellphone while driving and moving from lane unsafely.
