Russell man sues Cape Vincent over injuries suffered at water plant

CAPE VINCENT — A town of Russell man has sued the village over injuries he suffered while working on an expansion of the village’s water treatment plant.

William J. McDonald filed state Supreme Court action Wednesday at the Jefferson County clerk’s office claiming that he was injured when he fell from a ladder Aug. 15 at the filtration plant, 31317 County Route 6.

He claims to have suffered serious and permanent injuries, including fractures to his right foot, heel and ankle.

According to court documents, Mr. McDonald was working for Continental Construction Co., Gouverneur, when he stood on a ladder while working on the exterior of a pre-engineered building. The ladder unexpectedly shifted, causing Mr. McDonald to fall to the ground from a height of 5 to 7 feet.

The suit contends that the village was responsible for the supervision and management of the site, but was negligent, among other things, for failing to provide proper safety equipment. Such negligence allowed Mr. McDonald to use an inappropriate or unsafe ladder.

The suit also holds that the village otherwise failed to monitor the construction site to ensure workers’ safety.

Mr. McDonald claims the injuries he suffered caused him to lose wages and incur ongoing medical expenses, among other hardships.

The suit does not specify an amount being sought in damages.

Mr. McDonald is represented in the action by Syracuse attorney James E. Reid.
