A Calcium man has been charged with third-degree rape in connection with an April incident in which he allegedly had sex with a 19-year-old woman who was incapable of consenting.
Brett P. Murdock, 44, of 24619 Gonseth Road, Apt. 2, Calcium, was arrested Tuesday morning by city police when he turned himself in at the Metro-Jefferson Public Safety Building.
Mr. Murdock allegedly had sex with the woman, who was incapable to consent for some other reason other than being less than 17 years old, according City Court papers.
City Detective Sgt. Joseph R. Donoghue said the woman is a client of an unidentified facility, but the incident happened in a residence at 116 Keyes Ave. Mr. Murdock and the victim knew each other through family acquaintances.
She was not at the facility that night, Sgt. Donoghue said. She was at a friends.
Mr. Murdock was processed and taken to City Court, where he was arraigned before Judge Eugene R. Renzi.
Mr. Murdock was returned to the PSB with no bail because he has two prior felony convictions, the most recent in April.
On April 17, he pleaded guilty to failing to register as a sex offender after he was extradited from Louisiana. He admitted he moved from a Franklin Street apartment to Louisiana without notifying the state sexual offender registry.
The latest incident occurred during the night hours of April 18 and 19.
It happened the next day we brought him back, Detective Donoghue said.
Mr. Murdock was sentenced in February 2005 in Jefferson County Court to two to four years for first-degree unlawful imprisonment in a spousal-abuse case. He previously served a prison term for first-degree counts of attempted rape and attempted sodomy, according to the state Department of Corrections and Community Supervision website.
