Undocumented Polish man found in Ogdensburg sentenced to two months in federal custody

A Polish citizen who entered the United States illegally aboard an inflatable boat has been sentenced to two months in federal custody for the act.

Konrad Darlak, age not available, was sentenced Friday in U.S. District Court, Syracuse, by Magistrate Judge David E. Peebles after entering a guilty plea to entering the United States from Canada at a time and place other than designated by immigration officials in the United States.

According to a criminal complaint filed in the matter, U.S. Border Patrol agents on routine patrol encountered Darlak Sept. 16 at an unspecified convenience store in Ogdensburg. Agents said Darlak claimed to be from Poland, and upon further questioning, admitted that he had crossed the St. Lawrence River by boat without being inspected by immigration officials.

Darlak was in possession of a Polish passport that showed that he had entered Canada through an airport in Montreal on May 1. An immigration check showed that he had previously entered the United States on a visitor’s visa in May 2006.

He was processed for deportation in December for overstaying his visa and an immigration judge allowed him to leave the country voluntarily.

According to the complaint, Darlak left the United States April 11 from Chicago O’Hare International Airport bound for Poland.

Following his guilty plea and sentencing, Darlak was remanded to the custody of the U.S. Marshal’s Service and will again face deportation proceedings.
