Clayton man sued over alleged damage to vehicle

An insurance company is suing a Clayton man for about $18,400 in damages he is allegedly to have caused to a vehicle when he crashed it in December.

State Farm Mutual Automobile Insurance Co. filed state Supreme Court action Monday on behalf of Amanda M. Taylor, also of Clayton, against Tyler J. Fisk, claiming he took Ms. Taylor’s 2008 Audi without her permission on Dec. 12 and crashed it, causing the claimed damage.

Police charged Mr. Fisk, 24, in February with entering Ms. Taylor’s residence and unlawfully staying inside, prompting a second-degree criminal trespass count. Police also alleged that he took the vehicle and drove it at a speed that was unsafe for road conditions, causing the vehicle go off Bald Rock Road and crash into a creek. He was charged with third-degree unauthorized use of a motor vehicle, fourth-degree criminal mischief and fourth-degree criminal possession of stolen property, as well as fourth-degree grand larceny for allegedly taking a debit card from Ms. Taylor.

Criminal charges remain pending against Mr. Fisk in Jefferson County Court. He is serving three years’ probation imposed in December in County Court for an August 2012 guilty plea to fourth-degree criminal mischief, for which he admitted damaging property at a town of Clayton residence July 2. He was ordered to pay $1,546 in restitution in that incident.
