Norfolk man sentenced to jail for assault at Massena motel

MASSENA - A 23-year-old Norfolk man has been sentenced to serve 90 days in the St. Lawrence County Correctional Facility for an assault conviction.

Massena Town Justice Gerald P. Sharlow also ordered Dustin T. Gotham of 67 West Main St., Norfolk, to pay a $205 surcharge and pay a $50 fee to submit his DNA to the state data bank for his guilty plea to a third-degree assault charge. The plea also satisfied a petit larceny count.

Gotham had been charged with assault after he struck Alexander A. Forrestt on the right side of the face during an incident at 10:15 p.m. March 22, 2012 in Forrestt’ room at the Hillside Motel.

Mr. Forrestt told police his friend, Katie, and her boyfriend, later identified as Gotham, stopped at his residence after the couple had been at the Delmar Tavern.

“After they got to my apartment for a few minutes, Dustin wanted to leave and Katie did not want to leave. Dustin became forceful with her by trying to grab her arms and leave. I intervened and told him not to touch her arm and that he is disrespecting her, disrespecting me, Afterwords Dustin hit me in the head on the right side,” he added in his statement to police.

The petit larceny count stemmed from an incident in February 2012 when Gotham allegedly shoplifted a package of Trojan vibrating ring condoms from Hannaford’s.

In other recent court action before Judge Sharlow:

■ Sylvain Lafond, 44, of 5 Richards St., Massena, was fined $300 and a $260 surcharge for a driving while ability impaired conviction. His operating privileges were suspended for 90 days, and he was placed under a one-year conditional discharge.

Lafond had a blood alcohol content of 0.14 percent after troopers observed him eastbound in the westbound lane of state Route 37 at 10:54 p.m. Nov. 21. Troopers said after they activated their emergency lights Lafond drove across the grassy meridian to get into the eastbound lane.

In other recent action before Massena Town Justice James M. Crandall:

■ Angela M. Swinyer, 43, of 816 Pearl St., Ogdensburg, was placed under a one-year conditional discharge and ordered to pay a $125 surcharge after two petit larceny counts were satisfied by a plea to a disorderly conduct conviction.

State police had charged Swinyer with two counts of petit larceny at 12:51 p.m. Feb. 5 following a shoplifting incident at Walmart.

Store loss prevention associates told police they observed Swinyer select two packages of jelly beans and place them in her purse and then take several items from her cart and place them in her purse and under her shirt before walking into the vestibule past the last point of sale, where she was stopped by store personnel and found to be in possession of $90.19 worth of merchandise. She also reportedly admitted she had walked out of the store approximately 15 minutes earlier without paying for $24.59 worth of merchandise.
