Heuvelton man pleads in city court to impaired driving

A Heuvelton man pleaded guilty Tuesday in Ogdensburg City Court to driving while ability impaired.

Shawn M. Kennedy, 24, of 81 Rensselaer St., entered the plea to satisfy June 2011 charges of aggravated driving while intoxicated. Court records state he had a blood alcohol content of .23 percent when he was arrested. Under state law, aggravated driving while intoxicated is driving with a BAC of 0.18 percent or greater.

Judge William R. Small fined Mr. Kennedy $300, ordered him to pay $255 in surcharges and to enroll in a Drinker Driver Program, suspended his driver’s license for 90 days and granted him a one-year conditional discharge.

In other cases before Judge Small on Tuesday:

Lee C. Hurteau, 23, last known address 410 Deviller St., Ogdensburg, was granted an adjournment in contemplation of dismissal in six months of a November charge of second-degree harassment. He allegedly pushed Victoria L. Hurteau, of 605 Albany Ave., Ogdensburg, during an argument.

He was also ordered to abide by a no-contact order protection for Ms. Hurteau.

Scott E. Bower, 34, of 506 Barre St., Ogdensburg, pleaded guilty to second-degree harassment to satisfy a charge of second-degree criminal contempt.

He allegedly violated a court order of protection for Danielle Nichols. He was fined $100, surcharged $120, granted a one-year conditional discharge and told to comply with a no-contact order of order of protection for Miss Nichols.

Tara L. Lawton, 21, of 121 Belmont Courts, Ogdensburg, pleaded guilty to second-degree criminal contempt to satisfy two counts of that charge from March 2012 and August, second-degree criminal trespass from March 2012 and second-degree harassment from April 2012.

She was given three years probation, fined $100 and ordered to pay $200 in surcharges and a $50 DNA fee.

Jorge L. Rodriguez-Lopez, 50, of 413 Judson St., Ogdensburg, was granted an adjournment in contemplation of dismissal in six months of November charges of criminal obstruction of breathing and second-degree harassment.

Court documents identified the complainant as Cheri M. Briere, 30.

Jason E. Kerr, 37, of 1301 Ford St., Ogdensburg, was granted an adjournment in contemplation of dismissal in six months of a Jan. 13 charge of second-degree harassment. He was accused of punching Guy L. Bartlett, of 930 Ford St., Apt. 2, Ogdensburg.

He was also told to with a no-contact order of protection for Mr. Bartlett.

Melissa L. McLear, 31, last known address 509 King St., Ogdensburg, was granted an adjournment in contemplation of dismissal in six months and told to perform 20 hours of community service for a Jan. 10 charge of petit larceny from the Olympia Sports store, Gateway Plaza, Ford Street Extension.
