Former Watertown doctor sued over death of newborn

An Alabama woman is suing a former Watertown doctor for malpractice over the death of her newborn daughter in 2007.

Sandra M. Quinn, Dothan, Ala., formerly of Watertown, filed a state Supreme Court lawsuit Monday at the Jefferson County clerk's office against Dr. Mary J. Allen, Albany, Ga.

It is alleged the doctor was negligent and committed malpractice in caring for Mrs. Quinn and her daughter, Ella C., who died at Samaritan Medical Center two hours after her birth April 3, 2007.

The hospital is not named in the lawsuit.

Mrs. Quinn claims her daughter suffered severe injuries before her death, including pre-death conscious pain and suffering. It is further claimed, among other things, that Dr. Allen performed some, but failed to perform other, treatments or procedures without fully informing Mrs. Quinn of the risks or alternatives to the treatments.

The exact nature of how Dr. Allen allegedly was negligent is not stated in Mrs. Quinn's complaint. According to a death certificate filed in Surrogate's Court, the infant died of cardiopulmonary failure.

Mrs. Quinn is seeking through her lawsuit to recover funeral costs, which Surrogate's Court documents show were $695, as well as unspecified damages for the child's death. She is represented by attorney James P. Fitzgerald, Yonkers.
